Terms of Use

1. Parties and acceptance

These Terms of Use ("Terms") are between [ŞİRKET UNVANI] ("Trendio", "we"), which provides the Trendio app and website (the "Service"), and you ("user"), who use the Service. By creating an account or using the Service, you accept these Terms, the Privacy Policy, and the End User License Agreement. If you do not accept them, you should not use the Service.

2. Description of the Service

Trendio is an app that offers social media creators features such as profile analysis, a personal growth plan, daily tasks, chat with the AI coach Dio, content creation tools (Studio), trend suggestions, comment reply suggestions, and brand opportunities. Features, plans, and limits may change over time.

3. Account and eligibility

• You must be at least [YAŞ SINIRI] years old to use the Service.
• You sign in with Apple, Google, or an email code; you are responsible for keeping your account information accurate and up to date.
• You must keep your account secure, and tell us right away if you notice unauthorized use.
• You must own the social media accounts whose usernames you add or be authorized to manage them.

4. Subscriptions, trial, renewal, cancellation, and refunds

• Plans: Trendio Pro is offered as a weekly, monthly, and yearly subscription. Current prices are shown on the purchase screen, taxes included.
• Payment: The fee is charged to your Apple ID account when you confirm the purchase.
• Automatic renewal: Unless canceled at least 24 hours before the end of the period, the subscription renews automatically for the same period and price; the renewal fee is charged within 24 hours before the end of the period.
• Free trial: For plans that offer a trial, if you do not cancel at least 24 hours before the trial ends, it moves to a paid subscription. Any unused part of the trial period ends when you move to the paid subscription.
• Cancellation: You can manage and cancel your subscription on iPhone under Settings › [your name] › Subscriptions. Cancellation takes effect at the end of the current period.
• Refunds: Because purchases are processed by Apple, refund requests go through Apple's refund process. Trendio cannot issue refunds directly.
• Deleting your account does not cancel your subscription.

5. User content and license

The texts you write in the app, the videos you upload, your notes, and your media kit ("User Content") belong to you. You grant us a worldwide, non-exclusive, royalty-free license, which ends when your account is deleted, to process and store this content and pass it to our service providers, solely to provide, run, and improve the Service.

You agree that you hold all the necessary rights to the content you upload and that the content does not infringe the rights of third parties.

6. AI outputs

• The texts, ideas, analyses, and suggestions produced by Dio and the Studio tools ("Outputs") are generated automatically by AI; they may contain wrong, incomplete, or outdated information.
• Checking and editing Outputs before you publish them, and the consequences of using them, are your responsibility.
• To the extent the law allows, we assign our rights in the Outputs to you; similar inputs may produce similar Outputs for other users.
• You should not use Outputs in place of professional advice on health, legal, or financial matters.

7. Third-party platforms

Trendio is not affiliated with, endorsed by, or approved by Instagram, Meta, TikTok, or Apple. When you use these platforms, their terms and community rules apply. The app reads the public data of the username you add on your device; changes to the platforms' pages or rules may affect how some features work, and if data cannot be read you can enter the details yourself. We are not responsible for these changes.

8. Brand collaborations

The brand opportunities shown in the app are for information only. [MODELİNİZE GÖRE: Trendio is not a party to or an intermediary in the agreement between the user and the brand.] When you apply for an opportunity, the terms of the deal, payments, deliverables, and legal obligations such as labeling advertising/collaboration content as "ad" are between you and the brand.

9. Prohibited uses

• Using the Service to create illegal, misleading, hateful, harassing, or obscene content
• Fake engagement, bot networks, spam, or activities aimed at circumventing platform rules
• Collecting other people's personal data without permission or adding someone else's account without permission
• Using the Service for reverse engineering, scraping, automated bulk requests, or searching for security vulnerabilities
• Trying to get around limits and subscription controls, or sharing or selling your account to others

If these rules are broken, we may suspend or close your account without prior notice.

10. Intellectual property

The Trendio name, logo, the Dio character, the app design, the software, the content, and the Academy lessons belong to [ŞİRKET UNVANI] and are protected by intellectual property law. These Terms give you only the right to use the Service for your personal and commercial content creation; they do not transfer any other right.

11. Changing and ending the Service

We may change, suspend, or end the Service or its features. For changes that significantly affect paid features, we give notice a reasonable time in advance. You can delete your account at any time.

12. Limitation of liability

The Service is provided "as is" and "as available". To the maximum extent the law allows, we are not liable for indirect damages, loss of profit or followers, data loss, or decisions of third-party platforms (e.g., account restrictions). Our total liability is limited to the amount you paid for the Service in the 12 months before the date the claim arose. These limitations do not apply in cases of intent and gross negligence, or where consumer law does not allow them.

13. Indemnification

To the extent the law allows, you agree to hold us harmless against claims arising from your breach of these Terms or of the rights of third parties, and to cover the resulting damages.

14. Governing law and competent courts

These Terms are governed by the laws of the Republic of Türkiye. For disputes, the [İSTANBUL] Courts and Enforcement Offices are competent. If you act as a consumer, your right to apply to the Consumer Arbitration Committees or Consumer Courts, within the monetary limits set in the relevant legislation, is reserved.

15. Note on consumer rights

The right of withdrawal for digital content and services performed immediately may be limited under the exceptions in the legislation. For purchases made through the App Store, refund and withdrawal requests are subject to Apple's processes. Nothing in these Terms limits your non-waivable rights under applicable consumer law.
